UFCJC Public Relations Adjunct Lecturer Discusses the Legal Impacts of NIL on the NCAA and Student Athletes
Kristi Dosh, University of Florida College of Journalism and Communications Public Relations adjunct lecturer, is featured in a segment on the SEC Network’s “The Paul Finebaum Show” on Feb. 28.
Dosh, a sports business contributor for Forbes and the founder of BusinessofCollegeSports.com, discusses the injunction granted in Tennessee vs. NCAA. In this case, a district judge found that rules regarding name, image and likeness, or NIL, may have caused irreparable damage to athletes.
“This court order only applies to the eastern district of Tennessee, but generally the NCAA has treated any of these sorts of cases historic cases as applying nationwide…We wouldn’t expect them to really enforce any NIL rules, not that there has been a lot of enforcement action anyway…but we expect that they are not going to enforce anything specifically that isagainst collectives and boosters talking to recruits,” said Dosh.
“You’ve got the [House vs. NCAA] case which is now certified as class action. That’s a potential $4 billion case for the NCAA and that relates to student athletes who didn’t get to monetize their NIL because their eligibility was up before NIL or they only got NIL for a year or two. That case is going to be huge and will break the NCAA irretrievably…. If the House case does not go their way, I think it obliterates the NCAA.”
