David Cuillier Comments on Utah’s Handling of Public Records and Appeals
David Cuillier, director of the Brechner Freedom of Information (FOI) Project, was quoted in “Will Disbanding Utah’s Public Records Committee Streamline the Appeals Process?” published in The Salt Lake Tribune on Jan. 30.
The article focuses on how disputes are settled over public access to records. After more than three decades, the Utah Legislature could consider a bill that would disband Utah’s State Records Committee and send records disputes to a single administrative law judge.
“I believe that shifting that role to the judiciary, in a Government Records Access and Management Act small claims court of sorts, is the way to go,” said Cuillier.
According to Cuillier, “The key is that the entity making decisions needs to be independent to avoid political meddling and be able to issue decisions that are binding.”
